Touch - HTC or Apple?

Apple's new iPod has been unveiled as the 'touch' but this may mean it falls foul of HTC and a trademark they already hold on the HTC Touch smartphone.

The iPod touch may not be a phone, but it does share media playing functionality with the HTC handset as well as a touchscreen. 

The "HTC Touch" trademark application was filed on May 25. "Touch by HTC" was filed on August 8, 2007.  Apple has no approved or publicly applied trademark for "iPod touch."

"HTC Touch is a trademark, but I can't comment right now," said HTC president and CEO Peter Chou.

So what is Apple playing at? HTC will be no pushovers in a legal battle, but Apple has a history of winning out in these disagreements. We'll keep you informed as the story develops.
